I would say PS2 and Gamecube emulators are highly illegal unless you own the game in any format and have gotten it from a store before.

If you are emulating old systems like anything that is PS1 and before than your fine as long as you own the game it is not illegal, not like your gonna get caught but still.
There is a company that has made remakes of the original SNES all it does is read the old catridgtes but the point is when a product loses it's copyrights you are free to do with it what you want.

So it would be more risky to play the PS2 and Gamecube emulators since the consoles are still popular, right?

Yes Sony and Nintendo still retain the rights to each of their conoles so I would wait but as long as you don't show anyone it is basiclly impossible to get in trouble lol.

I don't really plan on downloading the GCN or PS2 emulators, I already own both consoles. Maybe some time in the future I'll get it, so I can play games that I don't own.

That is the bad part it will be illegal for a while they are re releasing every PS1 game on a PSP Emulator that you can buy and download old games and use them on your PSP.
I predict they will do this for the PSP2 for PS2 games or in the future so no matter what downloading any game where the company is still ALIVE is illegal but I have done it so it is really NP just letting you know.
Right now however even if the PSP is clocked back to the orginal setting of 333Mhz it still cannot run most PS2 games.

Oh, so Sony and Nintendo are both making the old games available for download onto the new systems.

What about the PS3? Will it also have this feature?
